WHAT IS THE AIM OF THE DECISION AND THE REGULATION?

The decision and the regulation are part of the European Union’s (EU) common foreign and security policy (CFSP) toolbox, promoting the CFSP objectives by providing the legal basis for EU sanctions in view of the situation in Guinea following the events of 28 September 2009 there.

KEY POINTS

The decision and the regulation, which have been amended numerous times, include:

  • the freezing of funds and economic resources for persons identified by the International Commission of Inquiry as responsible for the 2009 events in Guinea and their associates (as decided by the Council of the European Union);
  • a refusal of entry into EU territory for those same persons.

The persons subject to these measures are listed in the annexes to the regulation and decision. The Council decides on changes to that list.

Exemptions

The decision and regulation both allow exemptions from these measures, which include:

  • the release of certain frozen assets for legitimate purposes;
  • travel on humanitarian grounds.

FROM WHEN DO THE DECISION AND REGULATION APPLY?

  • Decision 2010/638/CFSP has applied since 25 October 2010. Its validity has been extended several times and it will currently expire on 27 October 2023.
  • Regulation (EU) No 1284/2009 has applied since 23 December 2009.
